Service Delivery

3. User Accounts

Account Creation

To use GetFacade.ai, you'll need to create an account. We make this process simple:

One account per person (no sharing accounts, please!).

Your Responsibilities

4. Subscriptions & Payments

Billing & Refunds

Subscriptions renew automatically unless cancelled.
Cancel anytime - you'll retain access until the end of your billing period.
Additional render tokens can be purchased as needed.
All prices are in USD unless otherwise specified.

Refund Policy

We want you to be satisfied with our Service. Refunds are available under the following circumstances:

Service Availability Issues: If you experience persistent service access problems, you may be eligible for a refund up to the amount of unused tokens in your current billing period, provided the request is made within 7 days of payment.
Erroneous Purchase: If payment was accidentally charged after your trial period ended when you did not intend to continue the subscription, please contact us within 7 days of the charge. We will review your case and may issue a full refund if the circumstances warrant it.
Refund Processing: All refund requests must be submitted within 7 days of the payment date for the current billing period. Refund amounts will not exceed the value of unused tokens in your account at the time of the request.

Refund evaluation data

When you request a refund through Apple App Store or Google Play, the respective platform may ask us to provide information about your use of the Service. In response, we may share the following data with the platform to assist in evaluating your refund request:

Account information: account age, account status.
Usage data: number of design generations, albums created, and other Service usage since the purchase.
Purchase history: total amount spent and total amount refunded through the platform.

This information is shared solely to help the platform make a fair refund decision and is not used for any other purpose. By using the Service and making purchases through these platforms, you consent to this data sharing as part of the standard refund evaluation process.

5. Intellectual Property

Our Content

GetFacade.ai and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. We grant you a limited license to use our Service according to these Terms.

Generated Designs

Here's the exciting part - the designs you create are yours to use:

You own the rights to designs you generate with your subscription.
Use them for personal or commercial projects.
Share them with contractors, architects, or clients.
We retain the right to use anonymized designs to improve our AI models.

6. Your Content

Your Content Rights

When you upload photos or other content to GetFacade.ai:

You retain ownership of your original photos and content.
You grant us permission to process and store them to provide our Service.
You confirm you have the right to use and share the content.
Your content must not violate anyone else's rights or any laws.

Privacy of Your Projects

We respect your privacy:

Your projects and designs are private by default.
We never share your specific projects without permission.
You control who sees your designs through sharing features.

7. Prohibited Uses & Fair Use

Prohibited Conduct

The following activities are strictly prohibited. Any violation may result in immediate enforcement action as described in Section 11:

Illegal activity. Using the Service for any purpose that violates applicable local, national, or international law or regulation.
Intellectual property infringement. Uploading, transmitting, or otherwise making available content that infringes upon any third party's intellectual property rights, including copyrights, trademarks, and trade secrets.
Reverse engineering and decompilation. Reverse engineering, decompiling, disassembling, decrypting, or otherwise attempting to derive the source code, algorithms, data models, or underlying architecture of the Service or any of its components, including our AI models and training methodologies.
Scraping and data extraction. Systematically accessing, scraping, crawling, harvesting, or extracting data, content, or other information from the Service through automated or manual means, whether for commercial or non-commercial purposes.
Unauthorized automation. Using bots, scripts, automated tools, browser extensions, or any other automated means to access, interact with, or generate content through the Service, unless expressly authorized by us in writing.
Circumvention of security measures. Attempting to bypass, disable, circumvent, or interfere with any security feature, access control, rate limit, usage restriction, authentication mechanism, or technical protection measure of the Service.

Account manipulation. Creating multiple accounts to circumvent usage limits, subscription restrictions, free trial limitations, or enforcement actions; using disposable or temporary email addresses for abusive purposes; or transferring accounts without authorization.
Credential sharing and resale. Sharing account credentials with third parties, sublicensing, reselling, or otherwise providing unauthorized access to the Service to any person or entity.
Competing service. Using the Service, its output, or any data derived from it to build, train, or operate a competing product or service, or to systematically resell generated content as a service.
Payment abuse. Engaging in any pattern of conduct that exploits the payment, refund, or subscription system, including but not limited to: initiating chargebacks or payment reversals in bad faith, repeatedly subscribing and seeking refunds or reversals, or otherwise manipulating billing mechanisms to obtain services without proper payment. Accounts associated with payment abuse may be permanently terminated, and we reserve the right to pursue recovery of any losses incurred.
Harassment. Harassing, abusing, threatening, or causing harm to other users, our staff, or any third party.
Misrepresentation. Misrepresenting AI-generated designs as actual completed construction projects, professional architectural plans, or certified engineering documents without clear disclosure of their conceptual nature.

Fair Use

The Service is intended for normal individual and professional use within the scope of the applicable subscription plan. We reserve the right to establish, modify, and enforce usage limits, rate limits, and fair use thresholds at any time. Usage that significantly and systematically exceeds normal patterns — as determined by us at our sole discretion — may be subject to restriction, throttling, or suspension without prior notice.

8. Privacy & Data Protection

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms.

Comprehensive Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No liability for damages: We and our representatives shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever.
Including but not limited to: Lost profits, lost revenue, lost savings, loss of data, replacement costs, construction variations, property changes, or any similar situations.
Regardless of cause: Whether based on contract, tort, negligence, strict liability, or otherwise, even if we've been advised of the possibility of such situations.
Design implementation: As a preliminary design tool, we cannot be responsible for variations that may occur during actual implementation of designs.
Third-party professionals: We're not responsible for the work or advice of contractors, architects, or other professionals you engage.
Maximum liability: Our total liability shall never exceed the amount you paid us in the past 12 months.

By using GetFacade.ai, you acknowledge and agree that:

Indemnification

You agree to defend, indemnify, and hold harmless us and our representatives, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your use of our Service or any designs generated.
Your violation of these Terms.
Any construction or renovation projects based on our preliminary designs.
Your violation of any rights of another party.
Any claims related to implementation of conceptual designs.

10. Warranties & Representations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND.

We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

Implied warranties of merchantability and fitness for a particular purpose.
Warranties that the Service will meet your requirements.
Warranties regarding accuracy, reliability, or completeness of any content.
Warranties that the Service will be uninterrupted or error-free.
Warranties regarding results obtained from use of the Service.

Some jurisdictions don't allow disclaimer of implied warranties. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Termination

Your Right to Cancel

You can cancel your subscription or close your account at any time through your account settings. Upon cancellation:

You'll retain access until the end of your current billing period.
Your data will be retained at least for 90 days in case you change your mind.
After 90 days, your data can be permanently deleted.

Our Right to Terminate

We reserve the right to take enforcement action against any account at our sole discretion, including but not limited to the following measures:

Warning. Issuing a formal notice of violation requiring immediate corrective action.
Restriction. Temporarily or permanently limiting access to specific features, reducing usage quotas, or throttling Service availability for the affected account.
Suspension. Temporarily suspending account access for a defined or indefinite period pending investigation or resolution.
Termination. Permanently terminating the account and revoking all access to the Service, including forfeiture of any remaining tokens or unused subscription period.

Enforcement action may be taken for any of the following reasons:

Violation of these Terms, including the Prohibited Uses and Fair Use provisions in Section 7.
Suspicious, fraudulent, or abusive activity, as determined by us at our sole discretion.
Conduct that threatens the security, integrity, or availability of the Service or its infrastructure.
Conduct that harms or threatens to harm other users, our staff, or third parties.
As required by applicable law, regulation, or legal process.

We reserve the right to apply any level of enforcement action without prior warning, including immediate termination, when the nature or severity of the violation warrants it. In particular, threats to system security, integrity, or availability may result in immediate account termination without prior notice. We are not obligated to provide advance notice of enforcement actions where doing so would compromise security, enable further abuse, or violate the law.
